Terms and conditions

General information

These general terms and conditions of sale apply between French Pals, a simplified joint-stock company with a capital of €23,525, having its registered office at 69 Rue d'Aboukir, 75002 Paris, France, registered in France with the Paris Trade and Companies Register under number 801117417, NAF code 1520Z, VAT number: FR44801117417, publisher of the website www.angarde.fr and owner of the ANGARDE brand, hereinafter referred to as "French Pals," and any person making a purchase on the website www.angarde.fr, hereinafter referred to as "The Customer." French Pals reserves the right to modify these general terms and conditions of sale at any time by publishing a new version on the Site.

These general terms and conditions of sale aim to define the contractual relationship between French Pals and the Customer, as well as the conditions applicable to any purchase made through the French Pals online store, whether the Customer is a professional or a consumer. The Customer declares that they have the capacity to enter into this contract, meaning they are of legal age and not under guardianship.

The Customer's order implies irrevocable acceptance of these general terms and conditions of sale, which take precedence over any other general terms and conditions not expressly agreed to by French Pals.

The sales contract is governed by French law.

Order

The offers are intended only for consumers with a delivery address in countries where French Pals provides delivery through a transportation provider. The products displayed on the site are valid only while supplies last.

In the event of a charge or payment for an order of an unavailable item, French Pals commits to refunding the Customer within fifteen (15) days, agrees to notify the Customer who placed an order for an unavailable item via email, and reserves the right to cancel any order from a Customer with whom there is a dispute related to payment for a previous order, in the event of a payment error or order error that may arise from a mistake.

Products

The products offered for sale are described and presented as accurately as possible. However, if any errors or omissions occur regarding this presentation, French Pals cannot be held liable. The photos representing our products are for indicative purposes only. These photos, as well as the texts illustrating the products, are not part of the contractual scope. Due to its suppliers, French Pals may deliver to the Customer an item with a slightly different composition than that described, but in any case, of equal or higher quality than the item ordered.

Prices

The prices presented on the site or the online store are final. They are indicated in Euros (€) and governed by French legislation. They are inclusive of VAT (All Taxes Included, including VAT). They are guaranteed subject to typographical or printing errors. These prices exclude fixed contribution to postage and packaging costs. The total price of the order (including all taxes and shipping costs) is indicated in the basket. Prices and flat-rate conditions including shipping costs may be modified at any time, without notice, particularly in the event of a change in tax or economic data. Items will be invoiced based on the rates in effect at the time the order is placed.

FRENCH PALS also offers a subdomain of its site for the United States: www.angarde.fr/en-us. This site displays prices in Dollars ($) and includes shipping fees.

Payments

Products or services must be paid for in Euros (€) or in Dollars ($). Any bank fees incurred by the payment, regardless of the method, will be charged to the Customer. The goods delivered remain the property of French Pals until payment is received. The transfer of risk occurs upon delivery of the goods.

A. Various Instant Payment Methods
Accepted payment methods include Credit Card (CARTE BLEUE / VISA / MASTER CARD, AMEX), PayPal, Apple Pay, and Bancontact (for payments in Belgium).

  • 2nd installment: 1/3 of the total 30 days after the order
  • 3rd installment: 1/3 of the total 60 days after the order

Conditions for using the 2 or 3 installment payment option with a credit card:

  • The total must exceed €50 including tax.
  • The Customer must be a resident of metropolitan France.
  • The Customer must be of legal age.
  • Payment must be made with a Visa or Mastercard (excluding Electron, Maestro, e-CB, and prepaid cards).
  • The credit card must be valid for 90 days following the first due date.
  • The Customer must electronically sign a credit agreement valid for less than 90 days, for which they have a withdrawal period of 14 calendar days from the date of signing.

This "Installment Payment by Credit Card" option is offered during the payment selection process. The Customer will be directed to the Alma service, where they can read the terms and conditions before proceeding with the installment payment.

Financing is provided by Alma, a simplified joint-stock company with a capital of €370,307.87 (RCS Nanterre 839 100 575), located at 176 Avenue Charles De Gaulle, 92200 Neuilly-Sur-Seine, authorized by the ACPR under number 90786 - Contact: support@getalma.eu.

Acceptance of the offer

Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products available for sale. The Customer's validation of the order signifies acceptance of the general terms and conditions of sale.

Invoicing

The invoice is sent to the email address provided during the order. It is issued in accordance with the rates in effect on the day the order is placed. FRENCH PALS disclaims any responsibility for errors in customer information entered during the order.

Shipping

A. Shipping

Delivery times do not include the order preparation time, which can vary from 24 to 48 hours (standard business days). Orders placed before 11 a.m. are typically prepared the same day. During holiday periods, sales, and collection launches, this time frame may be extended up to 10 days. This time frame is provided for informational purposes and remains subject to the actual receipt of payment.

After one month from the date of the order, FRENCH PALS will issue a refund by check or bank transfer for any undelivered merchandise (excluding pre-order periods).

B. Delivery times

Delivery times vary depending on location, the time of order, and the selected delivery method.

- For delivery in France : 2 to 4 business days depending on the selected method:

In a pickup point via Shop2Shop: 3 to 5 business days from the time of shipment. Note that if you choose delivery to a pickup locker, the processing time is 3 days (including weekends and holidays). If you choose delivery to a "classic" pickup point (such as a store), the time frame is 7 days.

To home: 2 to 3 business days from the time of shipment.

Express delivery via TNT: next-day delivery if the order is placed before 11:30 a.m. (except on Fridays, as there is no delivery on Saturday/Sunday or holidays).

- For delivery to the Euro zone : Belgium, Germany, Spain, Luxembourg, Netherlands, Italy: 3-5 days depending on the selected method. For the rest of the EU countries: 4-10 days depending on the country and method selected.

- For the rest of the world : 5-10 days depending on the method selected.

All these delivery times are provided for informational purposes only and are counted in business days; they depend on the availability of carriers, the order of arrival of orders, and available stock. French Pals strives to meet the delivery times indicated at the acceptance of the order, except in cases of force majeure or circumstances beyond its control, such as strikes, frost, fire, storms, flooding, without this list being exhaustive. Exceeding these time frames cannot be held against French Pals, nor can it result in contract termination or any compensation for damages.

The risks of transportation are the responsibility of the Customer from the moment the goods leave the warehouse. The Customer must check the condition of the packaging and the conformity of the delivered items and immediately report any anomalies to French Pals if applicable. Any reservations should be noted on the delivery slip presented by the carrier and sent via email within 48 hours to: contact@angarde.fr.

If the delivery country is not part of the European Union, customs duties will be the responsibility of the Customer. French Pals has no control over these fees, which are entirely the responsibility of the Customer.

C. Delivery costs

For delivery in metropolitan France :
- Delivery via Mondial Relay is free for purchases over €90 (otherwise €3.90). This option is also available for Belgium.
- Home delivery is available for €5.90.
- Express delivery costs €10.

For the Euro zone, the United Kingdom, and Switzerland, home delivery costs €10, or express delivery costs €20.

Right of withdrawal

The Customer has a period of 30 days from the date of receipt of the goods to exercise the right of withdrawal from their order. The date of the postmark or the date of the receipt of availability constitutes the start date of this period. The return or cancellation can pertain to all or part of the order.

To exercise the right of withdrawal online, the Customer must notify FRENCH PALS of their decision to withdraw before the expiration of the period by making their request on the returns page. The Customer will be redirected to the Elyn interface, French Pals' partner for digital returns. The Customer has three return options: exchange for the same item, exchange for another item at a different price, or a refund.

In any case, the Customer must return the item(s) subject to the right of withdrawal to FRENCH PALS without excessive delay and no later than 30 days from delivery (except during the holiday season, when orders placed between November 10 and December 20 can be returned until January 31 of the following year).

Refunds will be processed within a maximum of 14 days from the date French Pals is informed of the Customer's decision to withdraw, either by crediting the credit card used for the purchase or through the debited PayPal or Apple Pay account. The refund will include the amount of the item(s) subject to the right of withdrawal, excluding shipping fees. In any case, this refund cannot occur before FRENCH PALS has received the item(s) returned by the Customer.

Damaged, incomplete, or soiled products will not be accepted or refunded.

A. Free Exchange from France, Belgium, Germany, the Netherlands and Luxembourg

Returns are free from metropolitan France, Belgium, Germany, the Netherlands, and Luxembourg. After this period, no items will be exchanged. French Pals covers the return label (only for the first return slip). The item must be returned in perfect condition. For shoes, insoles must be in very good condition, in the original box with the transport pouch and cork soles. The shoe box must not be used as a shipping box. For clothing, the item must be returned in its original packaging with the label.

B. Paid Refund from France, Belgium, Germany, the Netherlands, and Luxembourg

You have 30 days after receiving the package to request a refund for your item. Return shipping costs of €3.90 will be charged to the Customer and will be deducted at the time of the refund.

C. Exchange and Refund from the Rest of the World

Requests for exchange and refund from the rest of the world are possible, but the return label generated for shipping is the Customer's responsibility.

D. Refund Conditions in the Case of a Special Offer

If the Customer requests a return on one or more items ordered under a "duo pajama offer" or "special basket offer," and only one item is returned, the applied discount will be deducted from the amount refunded for the returned item. If the Customer chooses to exchange for a more expensive item via the standard exchange (not instant exchange) and requests a refund for another item from the same order, the price difference between the two items will be deducted from the amount refunded.

If the item to be refunded is returned in poor condition and cannot be resold, the exchange for the other item will be canceled. The item intended for exchange will then be refunded, and the defective item will not be refunded and may be returned to the Customer at their expense.

Obligation of the parties

FRENCH PALS, upon acceptance of an order, commits to sell and deliver the products ordered by the Customer according to the terms specified above. FRENCH PALS agrees to ensure that the products comply with French regulations.

The Customer agrees to provide FRENCH PALS with an address where delivery can be made. Providing personal information (name, address, phone number, email address, etc.) collected for the purpose of concluding the sales contract is mandatory. This information is essential for processing and delivering orders and for issuing invoices. Failure to provide this information will result in the non-validation of the order. In the case of an error in providing this information, FRENCH PALS cannot be held responsible for the inability to deliver the product. In this situation, the Customer remains responsible for payment.

If an incomplete address is provided, resulting in the inability of the carrier to deliver, the Customer will be responsible for the shipping costs associated with resending their order.
